Art 4.1 Police Department

Location

HQ in Police Department Building in Downtown
Sherrif’s Office is considered as a secondary location subordinated to Downtown PD

Organization

Regulations

Commisioner is appointed by Mayor to oversee as top level management all PD Organizations across GTA
The Captain promoted through ranks runs the Downtown PD
The Sheriff runs Sheriff’s office
The police department serves GTA City assuring the safety of citizens.
The Police Department is obligated to take note of illegal activities and enforce the law by any means necessary
Police department is obligated to present to the DA or subordinates of DA all evidence and materials related to last arrest
The police department is obligated to answer citizen calls, verbal, or written notification of possibly illegal activities and to apply the law.

Commisioner

Responsible for running the police department and all it’s subordinated
Responsible to assign staff /create divisions/promote and hire
Firing a police personnel can be done through internal report signed by both Captain and Commisioner
Oversee training and activity of all officers.
Empower communication between PD and DA’s and it’s subordinates

Sheriff Office

A sheriff office is considered as a secondary HQ for Downtown PD, responsible for an area designated by PD Captain
A sheriff office can be created with approval of both PD Commisioner and GTA City Mayor to assure also infrastructure and logistics
A sheriff office can be dismissed by GTA PD Commisioner and personnel reassigned internally
A sherrif office can be dismissed by GTA Mayor if quota of min 2 deputees is not met, and for logistics/financial issues. All personnel will be reassigned inside GTA Downtown PD as per PD Captain’s decisino
Sheriff Office is run by PD Marshal
Sheriff Office must have min 2 max 3 deputees.
Sheriff and subrodinate can operate in the areas designated by PD Captain under PD Captain regulations and limitations if any
Sheriff and subrodiantes must always answer backup/execution roles from PD Captain

Art 4.3 Courthouse

Organization:

City Judge

Appointed/Dismissed by City Council vote
Must answers call to judge in courthouse and pass sentence based on professional experiecne and criminal record of the person found guilty
Nature of the sentance is at the liberty of the judge
All trials are held in GTA Courthouse
Is part of City Hall Organization

District Attorney

Is nominated/dismissed by Mayor
Can hire Assistants called DA’s Assistant and other beaurocratic staff
Must evaluate all cases received from PD and togheterwith Commisioner/PD Captain decide which goes to court or not
Must gather and organize all information about the case and present it to judge for sentance
Can delegate / collaborate to/with Prosecutor(s) the contents fo a trial case including the trial procedure
Reviews police activity regarding a case and advises on the legal procedure
Can advise commisioner and PD Captain regarding policies and public safety procedures

Prosecutor

Hired by/dismissed by ???
City lawyer who represents the government in criminal cases.
Is delegated/appointed by DA or DA assistant to review and proceed with the executino of a trial case
Arresting officers can not be prosecutors. Commisioner/DA will decide another person as prosecutor if needed.

Quick procedure guide

PD identifies crime, arrests as per penalty code and fill up report
PD to notify immediatelly DA Office
DA Office to evaluate the gravity of the crime and align with commisioner on the decision to take the case to court (optionally DA can delegate case to Proesectutor which will play similar role)
DA/Delegated Prosectuor to announce trial date to Judge and Guilty parties who are obligated to present themselves to court for sentencing
Guilty parties can request, obtain a laywer or defend themnselves
DA/Delegated Prosecutor and Guilty party(or laywer) to present accusation an defense to judge.
Judge to pass sentance
Note: In case Guilty party does not show up at court they will be arrested and held in jail until new court date is set
